1. General

1.1. The website located at
janervo.com(hereinafter: the "Site") is an online store operated by Naveh Chizin, an Exempt Dealer (hereinafter: the "Operator" or "we"), utilizing the commercial brand name "Janervo" to sell products for the home and home decor (hereinafter: the "Products"). -
1.2. These terms of use (hereinafter: the "Terms of Use") constitute a binding agreement between you and the Operator, governing access to and use of the Site, including purchasing products, browsing, contacting customer service, and uploading content. Any use of masculine pronouns in these Terms shall equally apply to feminine pronouns and vice versa, and to corporate entities, as context requires.

1.3. Any entry into and/or use of the Site, including browsing, purchasing, subscribing to mailings, or submitting details, constitutes your full and unconditional agreement to these Terms of Use as well as the Site's Privacy Policy. It serves as confirmation that you have read, understood, and agreed to be legally bound by them. If you do not agree to these Terms of Use, in whole or in part, please refrain from using the Site.

1.4. These Terms of Use apply to all use of the Site through any device, including computers, mobile phones, tablets, or any other means of access, whether available now or developed in the future.

1.5. These Terms of Use are drafted in accordance with Israeli law, including the Consumer Protection Law, 1981 (hereinafter: the "Consumer Protection Law") and its regulations, the Sale Law, 1968, the Contracts Law (General Part), 1973, the Electronic Signature Law, 2001, the Privacy Protection Law, 1981, and the Communications Law (Telecommunications and Broadcasting), 1982 (regarding direct mail marketing), as updated from time to time.
2. Definitions

"The Site" – The Janervo online store, including all its content, design, structure, and services provided therein.

"Operator" / "We" / "The Company" – Naveh Chizin, operating the Site under the brand name Janervo.

"User" / "Customer" / "You" – Any individual or entity browsing the Site and/or making use of it in any manner.

"Product" / "Products" – Home products offered for sale on the Site, including their descriptions, images, and prices.

"Order" – The act of purchasing a product(s) through the Site, including filling in information, selecting a payment method, and completing the payment process.

"User Content" – Any content, including reviews, ratings, comments, images, and videos, uploaded by users to the Site.
3. Legal Capacity to Use the Site

3.1. Any person who is at least 18 years old, holds the full legal capacity to perform binding legal acts, and possesses a valid credit card or other supported payment method in Israel is eligible to place orders on the Site.

3.2. A minor or any individual who lacks full legal capacity may use the Site and perform purchases only with the permission and supervision of a parent or legal guardian, who shall bear full responsibility for their actions.

3.3. The Operator reserves the right to deny access to the Site and/or cancel an order, at its sole discretion, for any user who violates the Terms of Use, provides false or incorrect information, or acts in violation of applicable law.
4. Use of the Site

4.1. The Site and its contents are intended solely for personal, non-commercial use. Commercial use of the Site and its contents, including copying, distribution, reproduction, republication, or exploitation for any business purpose, is strictly prohibited without prior written consent from the Operator.

4.2. The following acts are strictly prohibited: using the Site in a manner that infringes on third-party rights; attempting to hack, overload, or disrupt the operation of the Site or its servers; using automated tools (bots, scripts, crawlers, or scrapers) to gather data from the Site without authorization; bypassing security parameters; entering false data; and any use that violates applicable law.

4.3. The Operator may, at its sole discretion and without prior notice, block, restrict, or prevent access to any user who violates these Terms, without prejudice to any other remedies available under law.
5. Purchase Process and Contract Formation

5.1. Product Display: Each product on the Site is displayed with a description, price, and an illustrative image. Slight variations may occur between the product image and the actual product due to display differences on various monitors, lighting during photography, and color shades.

5.2. Placing an Order: To place an order, the user must fill out an order form containing identifying and billing details and confirm the order. Providing incorrect information may prevent the delivery of the order and expose the user to legal liability.

5.3. Order Confirmation: After an order is placed, an automated confirmation will be sent via email and/or SMS. This confirmation serves as a technical acknowledgment of receipt into the system only and does not constitute a final binding commitment to sell the product.

5.4. Formation of Contract: The engagement between the parties will be considered finalized and complete only after transaction approval by the credit card company or payment provider, verification of product inventory, and the dispatch of a final, official shipping confirmation notice by the Operator. Until such time, the Operator may choose not to approve the order for any reason, including stock shortages, pricing errors on the Site, or suspicion of fraudulent activity.

5.5. Refusal to Process Order: The Operator reserves the right to decline or cancel an order even after it has been confirmed, in cases involving: a typographical or clerical error regarding the price or product specifications; a technical glitch on the Site; an unexpected stock shortage; non-authorization of the transaction by the credit card company; or a reasonable suspicion that the order was placed fraudulently. In such cases, a notification will be sent to the user, and a full refund will be issued if a charge was already processed.
6. Prices, Payment, and Invoices

6.1. The Operator is registered as an "Exempt Dealer" (Osek Patur) for Value Added Tax purposes, in accordance with the Israeli Value Added Tax Law, 1975. Consequently, all prices on the Site are displayed in New Israeli Shekels (₪/ILS) and do not include VAT, as an Exempt Dealer is legally prohibited from charging VAT to customers.

6.2. The Operator reserves the right to update product prices on the Site at any time without prior notice. The applicable price for any order is the price displayed on the Site at the exact time the order process is completed.

6.3. In the event of a typographical error, human error, or technical glitch in the displayed price of a product, the Operator reserves the right to cancel the transaction even if it has been approved, provided that a notice is sent to the customer and their funds are fully refunded.

6.4. Payments on the Site are made via valid credit cards clearable in Israel and/or additional payment methods displayed on the Site (such as Bit, Apple Pay, etc., as integrated). Credit card data is transferred securely via an external authorized clearing provider and is not stored on the Site’s servers.

6.5. Upon completion of the transaction, a lawful transaction receipt/invoice will be generated reflecting the Operator's status as an "Exempt Dealer" (with 0% VAT) and sent to the email address provided during checkout. Should the Operator's VAT status change in the future (e.g., transitioning to a "Licensed Dealer" / Osek Murshe), this section will be updated accordingly, and tax invoices including statutory VAT will be issued.
7. Shipping and Delivery

7.1. The Site provides shipping services to customers within Israel only. Product delivery is handled by external shipping companies and/or postal services at the Operator's discretion.

7.2. Estimated delivery windows will be displayed on the product page or during checkout, generally ranging between 7 to 21 business days from order confirmation unless stated otherwise. These timeframes are estimates only, are non-binding, and may vary due to courier delays, remote delivery zones, holidays, or circumstances beyond the Operator's control.

7.3. Shipping fees will be explicitly shown during checkout prior to payment. Free shipping promotions may be offered based on a minimum order value, as published on the Site from time to time.

7.4. The customer is fully responsible for providing an accurate and complete address. The Operator shall not be held liable for delivery delays or failures arising from incorrect or incomplete shipping details provided by the customer.

7.5. If a product is not delivered within a reasonable timeframe beyond the estimated window, the customer should contact the Operator's customer service to investigate before taking any other steps.

7.6. In accordance with the Consumer Protection Regulations (Remote Sales), 2001, if the Operator is unable to deliver a product within 30 days of its scheduled delivery date, the customer will be notified and given the option to cancel the transaction for a full refund or agree to a new delivery date.
8. Transaction Cancellation, Product Returns, and Refunds
This section is drafted in compliance with the Consumer Protection Law, 1981, and the Consumer Protection Regulations (Cancellation of a Transaction), 2010, as amended and valid as of the last update.
8.1 General Right of Cancellation
A customer may cancel an online purchase within 14 days from the date of receiving the product or from the date of receiving the transaction disclosure document (whichever is later), in accordance with the provisions of the Consumer Protection Law.
8.2 Cancellation by Persons with Disabilities, Senior Citizens, or New Immigrants
A consumer who is a person with a disability, a senior citizen (over the age of 65), or a new immigrant (within 5 years of making Aliyah) may cancel a transaction within 4 months from the date of receiving the product, provided that the transaction involved a conversation (including via electronic chat) between the Operator and the consumer. The Operator may request appropriate documentation to verify eligibility.
8.3 How to Cancel
Cancellation notices must be submitted to the Operator via email, phone, or any other method published on the "Contact Us" page. The cancellation notice must include the customer's name, order number, and contact info to ensure rapid processing. Written notice via email is highly recommended.
8.4 Product Returns
The customer must return the product in its original packaging as much as possible, intact and unused, along with all accessories, parts, and documentation enclosed upon delivery. The product shall be returned at the customer's expense to the address provided by the Operator. However, if the cancellation is due to a defect, non-conformity with the details provided on the Site, or a delivery delay, the collection and its associated costs shall be the responsibility of the Operator.
8.5 Cancellation Fees

Cancellation for convenience: The Operator may charge a cancellation fee of up to 5% of the product's price or 100 NIS (whichever is lower), as stipulated by the Consumer Protection Law.

Cancellation due to defect, non-conformity, or delivery failure: No cancellation fees will apply. A full refund, including original shipping fees paid, will be issued within 14 days of receiving the cancellation notice.
8.6 Non-Cancelable Products
In accordance with Section 14C(d) of the Consumer Protection Law, transaction cancellations do not apply to: products manufactured specifically to the consumer's custom specifications (personalized items); hygiene products whose original packaging has been opened; or any other product legally excluded under the Consumer Protection Regulations.
8.7 Refund Timeline
If a cancellation is executed lawfully, the customer will be credited within 14 days of receipt of the cancellation notice, using the original payment method, minus any applicable cancellation fees outlined above.
9. Product Warranties and Liability

9.1. Products sold on the Site are subject to the warranty terms provided by their respective manufacturers and/or importers, if applicable, as specified on the product page or the accompanying warranty card.

9.2. Nothing in this section shall derogate from mandatory consumer rights under Israeli law, including the Sale Law, 1968, and the Consumer Protection Law regarding product non-conformity.

9.3. If a product defect or non-conformity is discovered, the customer must contact the Operator as soon as possible to receive instructions for an exchange, repair, or cancellation, depending on the circumstances and the law.

9.4. The Operator is not liable for any product damage resulting from misuse, failure to follow instructions, poor maintenance, normal wear and tear, or any unintended use of the product.
10. Intellectual Property

10.1. All intellectual property rights on the Site and its contents, including but not limited to the Site's design, structure, source code, images, texts, trademarks, the logo "Janervo", marketing materials, and graphics, are the exclusive property of the Operator or third parties who have licensed their use to the Operator. They are protected under copyright, trademark, and intellectual property laws in Israel and internationally.

10.2. You may not copy, reproduce, distribute, publish, reverse engineer, or make any commercial use of the Site’s content, in whole or in part, without the explicit prior written consent of the Operator.

10.3. The name "Janervo" and all related trademarks, symbols, or logos, whether registered or unregistered, are the sole property of the Operator, and no use may be made of them without explicit written authorization.
11. User Content, Reviews, and Ratings

11.1. The Site may allow users to upload content, including product reviews, ratings, comments, and photos (hereinafter: "User Content"). Uploading content is strictly voluntary and is the sole responsibility of the user who posts it.

11.2. By uploading content, the user declares and warrants that: they own all rights to the content or have obtained all necessary permissions; the content does not violate copyrights, trademarks, privacy rights, or third-party rights; the content contains no defamation, offensive, racist, misleading, pornographic, or threatening text; and the content does not include hidden advertisements or competitor promotions.

11.3. By uploading User Content, the user grants the Operator a royalty-free, perpetual, worldwide, irrevocable license to use, display, reproduce, modify, and publish this content across any of the Operator's platforms, including the Site and social media networks, for marketing and advertising purposes.

11.4. The Operator reserves the right, but is not obligated, to screen, edit, reject, or delete any User Content at its sole discretion and without notice, if it believes the content violates these Terms or applicable law.

11.5. The Operator bears no liability for User Content, including opinions, advice, or reviews posted by users, and such content does not represent the position or views of the Operator.
12. Privacy and Cookies

12.1. The use of the Site and any information provided by users is subject to the Site's Privacy Policy, which forms an integral part of these Terms of Use and can be reviewed on its dedicated page on the Site.

12.2. The Site utilizes "Cookies" and similar tracking technologies for its standard operation, enhancing user experience, data security, and statistical analysis, as detailed in the Privacy Policy.

12.3. The Operator implements reasonable and industry-accepted security measures in compliance with the law, but cannot guarantee absolute immunity from data breaches. The Operator shall not be held liable for unlawful database access provided that reasonable safeguards were taken.
13. Limitation of Liability and Disclaimer

13.1. Access to and use of the Site is provided on an "AS IS" and "AS AVAILABLE" basis. The Operator does not warrant that the Site will operate continuously, error-free, or completely immune to technical disruptions, malware, server downtime, or communication failures.

The Operator shall not be held liable for any indirect, consequential, incidental, or special damages, including loss of profits, data loss, or business opportunity loss resulting from the use or inability to use the Site, unless caused by intentional malice or gross negligence on the part of the Operator.

13.3. Product descriptions, images, and recommendations on the Site are provided for general informational purposes only and do not constitute professional consulting. The customer is responsible for evaluating the suitability of a product to their specific needs prior to purchase.

13.4. Nothing in this section shall derogate from mandatory consumer rights under the Consumer Protection Law or any other applicable law that cannot be conditioned or waived by contract.
14. Links to External Websites
The Site may include hypertext links to third-party websites, including social media platforms and external service providers. These links are provided solely for user convenience. The Operator does not control, endorse, or assume any responsibility for the content, privacy practices, or any damages arising from your use of those external sites.
15. Force Majeure
The Operator shall not be held liable for any failure or delay in performing its obligations under these Terms, in whole or in part, resulting from circumstances beyond its reasonable control, including but not limited to: war, acts of hostility, state of emergency, pandemics, natural disasters, labor strikes, lockouts, telecommunication or power grid failures, or any other event constituting "Force Majeure".
16. Changes to the Site and Terms of Use

16.1. The Operator reserves the right to modify, update, suspend, or discontinue any aspect of the Site, including its design, content, product offerings, and service availability, at any time, at its sole discretion and without prior notice.

16.2. The Operator may update these Terms of Use from time to time. The binding version is the most current version published on the Site. Users are encouraged to review the Terms periodically. Continued use of the Site following the posting of modifications constitutes full acceptance of the updated Terms.

18. Governing Law and Jurisdiction

18.2. The sole and exclusive jurisdiction over any dispute arising from these Terms of Use or the use of the Site shall be granted strictly to the competent courts of the Tel Aviv-Jaffa District, Israel.
19. General Provisions

19.1. Section headings in these Terms are inserted for convenience of reference only and shall carry no interpretive weight.

19.2. If any provision of these Terms of Use is found by a competent court to be invalid, illegal, or unenforceable, such provision shall be severed, and the remaining provisions shall continue in full force and effect.

19.3. A failure by the Operator to enforce any right or provision under these Terms in a specific instance shall not be construed as a waiver of such right or provision in any subsequent instance.
